Which personal data do we process?

Which personal data we process depends on the way you use our services.

We may process the following personal data, among others:

• name and contact details;

• company name and location details;

• job title and department;

• business e-mail address and telephone number;

• delivery and invoice address;

• data required to create and manage an account for the Forehand E-commerce Platform;

• customer number and other data linked to your organisation in our records;

• orders, quotations, deliveries and invoices;

• order references and comments you enter during the ordering process;

• correspondence with Forehand by e-mail, telephone or other communication channels;

• data about the use of our website and webshop, such as technical data, IP address, browser data and log data;

• data you provide to us yourself, for example via a contact form, account application or job application.

In principle we do not process special categories of personal data, unless this is necessary and a valid legal basis exists for doing so.

Forehand E-commerce Platform

Using the Forehand E-commerce Platform requires a personal account. This account is linked to the organisation you work for.

To create and manage this account, we process your name, business contact details and the details of your organisation, among other things.

When you place an order via the E-commerce Platform, we process the data necessary to fulfil that order. This may include, for example:

• the products and quantities ordered;

• prices and discounts;

• your order reference;

• delivery address;

• requested delivery;

• contact details;

• order, delivery and invoice data.

The Forehand E-commerce Platform is linked to our ERP system SAP Business One. Data required for the delivery of our services may be exchanged between the webshop and SAP Business One. This allows us, for example, to process and make available customer data, prices, product information, stock, orders, deliveries and invoices.

What do we use your personal data for?

We process personal data for one or more of the following purposes:

• performing and managing agreements with our customers;

• processing and delivering orders;

• creating and managing accounts for the Forehand E-commerce Platform;

• displaying customer-specific information such as prices, orders, deliveries and invoices;

• answering questions and providing support;

• meeting our financial and administrative obligations;

• maintaining business relationships;

• improving, securing and managing our website, webshop and services;

• preventing and investigating misuse, fraud and security incidents;

• complying with legal obligations;

• handling job applications;

On what legal basis do we process personal data?

We only process personal data when there is a valid legal basis for doing so. Depending on the situation, this may be:

• Sana Commerce as the supplier of our E-commerce Platform;

• suppliers involved in the management of SAP Business One and other business systems;

• carriers and logistics service providers;

• payment service providers, where applicable;

• accountants, advisers and other professional service providers;

• government authorities when we are legally required to provide data.

When a party processes personal data on our behalf, we make agreements about the protection and security of this data where necessary.

Transfers outside the European Economic Area

When personal data is processed outside the European Economic Area by a service we use, we ensure that a valid legal basis and appropriate safeguards are in place.

Security

Forehand takes appropriate technical and organisational measures to protect personal data against loss, misuse, unauthorised access, unwanted disclosure and unauthorised alteration.

Access to personal data is limited to persons and parties who need this data to carry out their work.

How long do we keep personal data?

We do not keep personal data longer than necessary for the purpose for which it was collected, unless we are legally required to keep the data longer.

For data that forms part of our financial and tax administration, we apply the statutory retention periods that apply to it.

Account, customer, order and communication data is kept for as long as necessary for the customer relationship, our services, warranty and service obligations and any legal obligations.

When data is no longer necessary, it is deleted or anonymised.

Your rights

Under the GDPR you have various rights regarding your personal data.

You can, among other things, request us to:

• provide access to the personal data we process about you;

• correct or complete inaccurate data;

• erase personal data;

• restrict processing;

• transfer personal data, where the right to data portability applies;

• object to certain processing activities.

When a processing activity is based on your consent, you also have the right to withdraw that consent.

Submitting a complaint

If you have a complaint about the way Forehand handles your personal data, we ask you to contact us first so that we can investigate your complaint.

You also have the right to submit a complaint to the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

Changes

We may amend this privacy statement when our services, our systems or laws and regulations give cause to do so.
